As has already been mentioned, you were clearly there to PVP since you were holding a sword. If you wanted to switch away from your diamond sword to show that you're a non-combatant, you probably shouldn't have switched to
another sword.

By the time you exit the portal, wait a few seconds for the lag to dissipate, switch weapons, and start sending a chat message, you are no longer "trying to get your bearings straight." If the goal of the rules governing the nether is to protect people who "just came into the nether," then wouldn't Kress be more protected than you by these rules, since the fight started when he just entered but you were already standing around there?
The only "incident" to discuss is your inordinate anger at being killed in PvP while standing around holding a sword in the one part of the server where PvP is always on. Also, please note that Intelli has reportedly fixed the bug that allowed placement of water in the Nether... so no matter how hard you cry, no water block will appear there.
