Actually, I'd argue otherwise, VV. Mitchie's realms aren't the first thing new players see, or the central location for the entire server. While Intelli, Torn, and Rokkr can obviously do what they likes with their realms, I'd say they have a responsibility to at least make it look good.
Remember the rule instituted regarding spawn realms? They have to look at least reasonably good, or be part of a project in progress, else they will be force-sold to the highest bidder. As I understand, this applies to Intelli's, Torn's, and Rokkr's realms as much as, if not more than, it applies to ColdF3ar's or Frosty's. They are under no obligation to choose the specific design Mitchie has created, but making it look good should be a priority, and considering Spawn itself to be equivalent to Mitchie's realms is fallacious, as changing it would fall under the category of "server development".
Look at it this way. If the US government were to hold a vote for a redesign of my house, it would be ridiculous; it's private property. But if were to hold such a vote regarding a reorganization of the White House, it would be much more reasonable. Really, it comes down to the following question: is Spawn considered Intelli's private property, or is it considered property of the MineRealm government?
TL;DR: The owners of Spawn don't have to use Mitchie's design, but they have a responsibility to make them look good. Also, whether Spawn counts or should count as private property is debatable (although Intelli obviously has the last word).
