Your metaphor for rich - new/poor - old players is broken as well. I could argue that players with more money shouldn't be banned because they can contribute to the server more. It's also blatant favoritism and leniency, and SOME leniency is ALREADY granted in the case of newer players, barring someone who clearly joined with "malicious" intentions.
Taking a brief break from smashing your suggestion with a brick, I'd like to talk about this statement.

You know what inspires sympathy? Apologizing for doing something wrong. Even in the judicial system, leniency is occasionally shown when regret for ones actions are shown.
