I think both of these issues could be addressed, however. By putting it at or near Spawn City (where there are almost always players anyway, so the chunks are almost always loaded), the increase in lag would be minimized. And there could be a code so that if the server is full and a legitimate player tries to join, one of the banned/jailed players gets kicked out (similar to the feature following the map wipe, where the server capacity was lower and Intelli used a code to kick out a normal player when an admin tried to join).
Additional suggestions:
1) Put glass windows at eye level around part or all of the jail's perimeter, so unjailed players can watch and laugh at the jailed ones.
2) Put one or more [lava pits] inside the jail. That way, the inmates will have precisely one activity, [swimming in lava], to occupy their time in jail (and it could also entertain unjailed players).
