Because staff have to decide what is fair and what's not. And as pointed out by prodigy, you can never really tell. There are few pvp rules because of the ambiguity. If you don't like unfair pvpers, pvp with people you trust or don't pvp at all.

I beleive people should agree to open up a can of pvp on each other. Not just blind side people in the neather while luring them with promises of free passage and candy, then BLAM! You wasn't pvping? then how come you had a sword? oh pig man you say? then how come you swung at me? you thought I was a pigman? tsk tsk dude.

Sorry didn't mean to talk to myself. but still I say people should agree on pvp in the neither, otherwise assume they are just collecting stuff i.e. soul sand and nether brick, traveling from one place to another, and leave them alone.

Lol people not killing people who pass through, yeah right. The only people I've seen get by, is when Vortex is in the nether and its a friend that I tell guildies not to kill. I've NVER seen someone pass through when the other groups are camping it.
