I think this is fairly self-evident as to what he's doing in violation of the rules.

This was followed up by a conversation where he said he had no idea it was illegal on this server.

Unfortuanatly I did not screenshot that.

I was there at the time and saw the whole thing, but unless someone did screenshot the required parts, there is nothing to ban on.
