Here's what I think about this story. Both parties are stupid and here's why - Bethesda, who will be releasing Rage with Id software this upcoming Tuesday, is out of their mind for thinking that Notch has stolen their name. Really?? It's a word, he used the word "Scrolls." Don't be like Apple here and think that people are stealing something you invented, "Scrolls" is a word, and anyone can use it. I would understand their anger if Mojang used "The Elder Scrolls" as the name, but they didn't...
Now Notch made a mistake by asking Bethesda to get 3 of its best Quake 3 Arena players together so that Notch and his team of 3 could play them in a match. If Bethesda won they got to choose the new name for "Scrolls," if Mojang won, they kept the name. Now I know it's cool that Notch doesn't want to deal with a stupid argument like "hey you stole our name," but trying to avoid a lawsuit by playing a video game? Come on.
And now it's being taken to court. This could've been settled a lot sooner, or it could have never happened at all if Bethesda wasn't so worried about stupid crap like this.
Just my opinion and how I hate the trademarking system.

The bigger reason why it was stupid for Mojang to make a Quake 3 challenge is because not only does Bethesda currently own Quake 3, but they also happen to have several professional Quake players currently working for them.

Because of this, I'm never buying any Bethesda games again, and I'm certainly not alone in this.

That's exactly the reason why they wouldn't take the chalenge. If they'd lost, they'd never hear the end of it.

Bethesda is stupid for not accepting. Now they're going to lose a legal battle.

I'm not wholly convinced that someone at Bethesda with some degree of power doesn't WANT to lose this, as it's fairly asinine, and Notch is clearly a big fan of theirs. I'm inclined to think that the legal team has dragooned the more reasonable people into this whole thing.

But, as Deimos said, they are smart for not accepting. If they lost, they would be the most humongous fail of the gaming industry. But, they will still be the most humongous fail of the gaming industry because they will lose this battle anyway.
They screwed themselves as soon as they tried to sue Mojang.
